Law Firm Helps Michigan Family Win Fight Over Yard Nativity Scene

Monday, December 5th, 2005

This article is close to my heart. Apparently some folks who run a sub-division management company in Michigan are ACLU wannabee’s.

(AgapePress) – A Michigan family threatened by the company that manages their housing subdivision with hundreds of dollars in fines for placing a Nativity scene in their yard will be allowed to keep the holiday display after all.
Each Christmas season the Samona family of Novi, Michigan, displays a Nativity scene on their front lawn. That Christmas crèche has been part of their family’s traditional celebration of the holiday ever since they moved into their new home three years ago. This year, however, the management company that oversees the Samonas’ subdivision sent them a letter demanding they remove the Nativity scene or face fines of up to $100 per week.
Unwilling to comply with the demand, the family contacted the
Thomas More Law Center, a national public-interest law firm based in Ann Arbor, Michigan. The Law Center agreed to represent the Samonas at no charge and, on November 30, contacted the management company on the family’s behalf.
Shortly after hearing from the family’s legal representatives, the company reversed its position and sent the Samonas a letter informing them that their Nativity scene was not in violation of any rules or regulations of the subdivision. The company also apologized for any distress its initial letter might have caused and the sent the family a gift basket, calling it “a token of our remorse, in the spirit of this holiday season.”
Edward White, trial counsel for the Thomas More Law Center, says the initial demand to remove the Nativity scene was “outrageous,” despite the management company’s subsequent apology. Think of it: as a private citizen “you believe in your faith, it’s Christmastime, you put up a display that is beautiful. It was no danger,” he contends; but, nevertheless, “apparently someone in the community complained.”
White says hundreds of citizens visited the Samona family home to view the Nativity scene and express support for the family after word of the controversy got out. “As I was mentioning to people who’d come by and in my conversations with the family,” he recalls, “you’ve got to remember that there’s always going to be an Ebenezer Scrooge out there who doesn’t like something and will complain.”
Still, the Thomas More attorney insists, people have a constitutional right to express their religious messages on their own property — something he feels the management company ought to have recognized from the beginning. “Common sense has to apply here,” he says. “It’s one thing to paint the house orange and put junk in the front yard, which would lower the values of the property. It’s another thing to put up a temporary holiday display at Christmastime or to put a flag outside your house on federal holidays or the Fourth of July or everyday.”
That sort of positive-value display “only adds to a neighborhood,” White asserts. “It doesn’t detract from a neighborhood.” Moreover, he says, “The Samonas are a great example for everyone. They showed that people should fight for what they believe in.”
White adds that he is glad the Thomas More Law Center was able to help the Samona family and that the firm is also pleased the management company “quickly realized the mistake it had made and corrected the matter.” Meanwhile, a TMLC news release notes that the family requested the company’s gift basket be forwarded to a charitable organization, the Saint Vincent DePaul Society in Pontiac, Michigan.

Hawaii Supreme Court: The Unborn Are ‘Not Human Beings’

Monday, December 5th, 2005

As proof of further degradation of the family, the Hawaii Supreme Court has ruled that unborn children are still fetuses and “not human beings” until after they are born.

(AgapePress) – Wednesday, November 30, the Supreme Court of Hawaii overturned the manslaughter conviction of Tayshea Aiwohi. The 32-year-old woman had been previously found guilty for causing the death of her newborn son by smoking crystal methamphetamine three days before his birth and on the morning he was delivered.
The State’s High Court unanimously ruled that Aiwohi’s son was an unborn fetus at the time she abused crystal meth, and therefore not a person. WorldNetDaily rightly characterized the decision in this fashion, saying that in Hawaii unborn children are “‘not human beings,’ and therefore women cannot be prosecuted for causing the death of babies by harmful behavior during their pregnancies.”
According to the Honolulu Star Bulletin, Hawaii’s penal code states that a person is defined as “‘a human being who has been born and is alive.’ Most states allow for the prosecution of a person for violence against a pregnant woman resulting in the death of her child after birth. Thirty-four states have ‘fetal homicide’ laws allowing prosecution of a person for causing the death of a fetus. Most infamously, Scott Peterson faces the death penalty in California for his conviction of two counts of murder for the deaths of his wife, Laci, and their unborn child.”
But in Hawaii there is no such law. And so open-ended is the matter in Hawaii, Justice Paula Nakayama wrote “that ‘the logical implication’ from the Aiwohi ruling is that a person who attacks a pregnant woman, causing the child’s death after birth, ‘also cannot be prosecuted [for the child’s death] under the manslaughter statute, inasmuch as the Legislature has not included fetuses within the definition of the term ‘person.'”

Maybe Hawaii can catch up with the majority of states that have unborn child protection laws on their books. The little ones need to be protected. They can’t do it themselves. Pray for this.

Do you have your manger scene up yet??

Monday, December 5th, 2005

With the constant attacks from the ACLU on manger scenes in public, I fully support the grass roots efforts to have a manager scene in almost every yard of every house in America. I’ve done my part. Have you done your’s yet?

Luke 2:6-7 New International Version (NIV)
While they were there, the time came for the baby to be born, and she gave birth to her firstborn, a son. She wrapped him in cloths and placed him in a manger, because there was no room for them in the inn.

Christians Persecuted in the Holy Land

Monday, December 5th, 2005

Pray for these brother’s and sister’s in Christ. They are experiencing a lot hurt for the Lord.

CWNews.com – Two thousand years after the birth of Christ, Christians are leaving the Holy Land in record numbers. Now, a new report suggests persecution against Palestinian Christian believers is getting worse.
Charred ruins are all that remain of 14 homes set a blaze in the West Bank village of Taybeh. An angry Muslim mob, from a neighboring village, attacked the Christian town last September. They said they were avenging the dishonor of a Muslim woman allegedly impregnated by her Christian employer from Taybeh.
Taybeh is the only West Bank village completely inhabited by Christians, about 2,000 of them. Originally, it was called Ephraim in the Old Testament; and in the book of John it is mentioned as a village where Jesus stayed.
David Khoury is the Mayor of Taybeh. He says the attack would not have occurred if Taybeh were a Muslim village instead of a Christian one.
Khoury said, “It’s happened many times between a Muslim and a Muslim; and what they did was, most times, just marry the girl off. Had they given us a chance, and proved this pregnancy was by the man from Taybeh, maybe we would have married him to that girl.”
Palestinian officials are downplaying what happened here—depicting it as a dispute between families—the result of an out-of-wedlock romance. But some villagers insist the incident was “pure religious hatred”—that Taybeh Christians were used as scapegoats. Some of the 400 attackers were reportedly heard shouting “Allahu akbar—‘Allah is great’”—as they threw molotov cocktails at Christian houses.

Going to Bethlehem

Monday, December 5th, 2005

Luke 2:4-5 New International Version (NIV)

In those days Caesar Augustus issued a decree that a census should be taken of the entire Roman world. (This was the first census that took place while Quirinius was governor of Syria.) And everyone went to his own town to register.

So Joseph also went up from the town of Nazareth in Galilee to Judea, to Bethlehem the town of David, because he belonged to the house and line of David. He went there to register with Mary, who was pledged to be married to him and was expecting a child.

El Baradei: Iran only months away from a bomb

Monday, December 5th, 2005

OK Folks,Time to Wake Up Here!!! If this doesn’t scare you a lot, then you are the one with the problem.

IAEA chairman Muhammad ElBaradei on Monday confirmed Israel’s assessment that Iran is only a few months away from creating an atomic bomb.
If Teheran indeed resumed its uranium enrichment in other plants, as threatened, it will take it only “a few months” to produce a nuclear bomb, El-Baradei told The Independent.

If anyone thinks for one second that Iran will not bomb Israel at the earliest moment and that Israel will not retaliate, then you have a very bad case of “ostrich head in the sand” syndrome. If there was ever a time for the world to come fourth and take strong military action aginst a nation, this is it. As Jennifer pointed out, not only will Iran take action against Israel, they will share these weapons with other terrorist. Things are going to get ugly soon.

Also there’s more:

MOSCOW (Reuters) – Iran has signed a deal to buy Russian tactical surface-to-air missile systems, a Russian newspaper reported on Friday.
Iran is to buy 29 TOR-M1 systems, designed to bring down aircraft and guided missiles at low altitudes, said the Vedomosti daily, citing Russian defense sources close the deal.
The deal is the biggest sale of Russian defense hardware to Iran for about 5 years, the newspaper said. It did not say how much the order was worth.
Defense industry officials could not immediately be reached for comment.
Tehran is under intense international pressure after failing to convince the United States and others its nuclear scientists are working on fuel for power stations rather than bombs.
Russia is helping Iran build a nuclear power station at Bushehr.

Read the rest here and see my post.

And to make sure that Iran can pull off the destruction of Israel:

WASHINGTON – Russia has signed a deal with Iran to sell 29 of its Tor M-1 anti-missile systems, a development that will complicate any planned pre-emptive attack on the rogue nation’s nuclear facilities, reports Joseph Farah’s G2 Bulletin.
The system would theoretically permit Iran to intercept some cruise missiles as well as airborne missiles that U.S., Israeli or other western countries might use in an effort to keep the terrorist-supporting nation from developing nuclear weapons or using them.

But the weapons Russia is providing is only for defensive purposes only.

Russia’s weapons sales to Iran are purely for defensive purposes, a government spokesman said Saturday, in response to reports that Russia was selling $1 billion worth of weapons to Iran, AP reported Saturday.
Yeah Right!!! Read the rest of this nonsense here.

Things seem to be certainly speeding up in regards to end time Prophetic Signs. Read this great information put together by my friends Ben and Jennifer Rast at Contender Ministries.

Suicide bombing outside Netanya mall kills 5

Monday, December 5th, 2005

Well, guess it shows that giving the pali’s a bunch of land didn’t do much good. I hope the Sharon and Israel understand that nothing is going to bring them peace other then their complete destruction or God’s intervention. Of course, God will intervene before they are destroyed, so I guess the solution is the same in both cases.

Four people were killed and 63 were wounded – three seriously – in an explosion that rocked the entrance to the Hasharon shopping mall on Herzl Street in Netanya at 11:30 a.m. Monday morning. Another person died on the operating table at Laniado Hospital in Kfar Saba.
Police Insp.-Gen. Moshe Karadi told reporters that the bomber was “identified 15 meters in front of the mall by policemen and a security guard. Police managed to keep him away from the gate, and he blew himself up when police approached him to conduct a search of his bags.”
According to Karadi, “Members of the security services were hurt in the event,” but “the actions of the guards and the police prevented a much more deadly bombing.”
Magen David Adom reported that all of the wounded were evacuated to
Laniado, Meir and Hillel Yaffe hospitals. Nine wounded were taken to Laniado, including one who died after arrival. Hillel Yaffe received 22 wounded and 28 were evacuated to Meir Hospital.
The Islamic Jihad took responsibility for the attack in a phone call to Palestinian journalists, identifying the bomber as Lutfi Amin Abu Salem, a resident of the northern West Bank village of Kafr Rai, located between the towns of Jenin and Tulkarem. However, a radio station in the Gaza Strip reported that the Fatah-affiliated Al Aksa Martyrs’ Brigades terror group claimed responsibility for the attack.

And yet here is another example of Israel bending over backwards to accommodate the palis while they do nothing to rein in the terror groups.
